Our goods are made with natural and aromatherapy ingredients. Despite significant efforts and precautions taken to ensure that the goods are completely safe for human consumption, it is conceivable that certain substances may trigger allergic responses in some people or negatively affect people who have pre-existing medical issues. Please read the contents and usage and caution instructions that come with each of our goods to ensure that they are safe for you to use. Before using any of our personal care items to which you may be allergic, you must take all necessary precautions and seek professional medical/dermatological advice. You accept that Maruti Natural Fragrances is not responsible or liable for any product-related concerns, including but not limited to any allergic reactions you may experience as a result of using our goods. You will be governed by the limitation of liability and disclaimer conditions provided in further detail with the product packaging/leaflets/details on the Site for any purchases made through the online store, among other things.
Furthermore, to the greatest extent permitted by law, we will not be liable for any indirect, special, punitive, incidental, or consequential damages of any kind (including lost profits) arising from the website or your use of it, regardless of the form of action, whether in contract, tort (including negligence), or otherwise, and in no event shall our maximum aggregate liability exceed INR 2000/-.
You agree that no claims or actions arising from or linked to the website or these terms and conditions may be made by you more than one (1) year after the cause of action leading to such claim or action originated.
Indemnification
You undertake to defend, indemnify, and hold us harmless for any loss, damages, or costs, including reasonable attorneys’ fees, incurred as a consequence of any third-party claim, action, or demand arising from your use of the Site or breach of these Terms and Conditions. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys’ fees, incurred as a result of your use of software robots, spiders, crawlers, or other data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.
Disputes All rights and obligations, as well as all actions contemplated by these Terms and Conditions, shall be governed by the laws of India and the courts of New Delhi, India, as if the Terms and Conditions were a contract wholly entered into and wholly performed within New Delhi, India, subject to foreign legal mandatory provisions. Every dispute, difference, or claim arising from your visit to the Online Store shall be addressed to the sole Arbitrator chosen by the Chairman and Managing Director of BKBPPL in accordance with the law. The arbitration shall take place in New Delhi, India, and the arbitrator’s decision shall be final and binding on all parties, and may be entered as a judgement in any court of competent jurisdiction. No arbitration under these Terms and Conditions shall be joined to an arbitration involving any other party subject to these Terms and Conditions, whether through class arbitration proceedings or otherwise, to the fullest extent authorised by applicable law.
Agree to Receive Notifications Electronically through Site Posting and Email
You agree to receive from us electronically any agreements, notifications, disclosures, and other communications (collectively, “Notices”) to which these Terms and Conditions pertain, including without limitation by e-mail or by posting notices on this Site. You agree that any Notices we send you electronically will meet any legal requirement that such communications be in writing. To withdraw your consent to receive Notices electronically, please contact us by emailing us at care@marutiessentialoils.com and terminate your usage of this Site. In such case, all rights granted to you under these Terms and Conditions, including but not limited to the restricted licences outlined in Section 5 hereof, will automatically end. We regret that we cannot deliver the benefits of this Site to any user who does not consent to receiving Notifications electronically.
